Destin Florida Short Sale - Three Challenges To Approval Destin Florida short sales

Chase just approved this Destin Florida townhome for short sale. The process was a challenge. There were past due association fees and a judgment recorded in Walton County. In Florida, a property cannot be sold unless liens and judgments are paid or "released" at closing. Here is how we tackled the short sale:

1. Chase. The Chase part of the short sale was pretty straightforward. The negotiator was difficult to reach, and I attempted calling her several times over the course of a few weeks. When I finally spoke with her, she told me her files had doubled in the last two months and Chase was behind processing their short sales. The best way to reach her was by fax. After making contact, Chase approved the file fairly quickly. It pays to be pleasant on the phone, by the way!

2. The Judgment. In order to close on the Destin Florida short sale, the title agent needed a partial release from the creditor. The creditor agreed to the release in exchange for a small cash contribution from the seller.

3. The H
omeowner's Association. There were about $16,000 in past dues owed. Chase would pay half. Would the association agree to settle for less? I asked the seller to contact the association directly and mention Florida Statute 720.3085. It stipulates:

Notwithstanding anything to the contrary contained in this section, the liability of a first mortgagee, or its successor or assignee as a subsequent holder of the first mortgage who acquires title to a parcel by foreclosure or by deed in lieu of foreclosure for the unpaid assessments that became due before the mortgagee's acquisition of title, shall be the lesser of:
1. The parcel's unpaid common expenses and regular periodic or special assessments that accrued or came due during the 12 months immediately preceding the acquisition of title and for which payment in full has not been received by the association; or
2. One percent of the original mortgage debt.
Given that $8000 was more than a year back dues, I thought the association would be delighted to "settle" and get a new paying owner. They were.

Holley by the Sea, Navarre FL - VA Compromise Sale Approved


GMAC has approved the VA Compromise Sale for this Holley by the Sea home in Navarre Florida.


A VA Compromise Sale is similar to a short sale. If you have a VA mortgage, and need to sell your Navarre, Crestview, Fort Walton Beach or Destin home because you can no longer afford your mortgage payments, you may qualify for a VA Compromise Sale. Your mortgage balance must be higher than the market value or anticipated sales proceeds, and you don't have the cash difference to bring to closing.


Some of the requirements for a VA Compromise Sale are:

1. You may only sell the home for fair market value. This value will be determined after you submit a contract to your mortgage lender, who is delegated to handle your VA Compromise Sale. The VA appraisal is valid for six months.

2. The closing costs must be "reasonable and customary".

3. You must have a valid financial hardship such as loss of income, relocation (such as PCS move to a new base), death of breadwinner, etc.

4. There should not be a second mortgage on your property, unless it is "insignificant". VA may allow a small amount to pay your junior lien, but you might have to make other arrangements.


One of the biggest questions I receive about VA Compromise Sales from Eglin AFB and Hurlburt Field Airmen is:

"Will I be responsible to pay back the deficiency from the sale?"


VA says no - "If your loan closed on or after January 1,1990, you will owe the Government in the event of a default only if there was fraud, misrepresentation, or bad faith on your part."

Mortgage Help Expands to Santa Rosa Beach, Destin, Crestview Florida



If you need help making paying your mortgage in Destin, Santa Rosa Beach, Crestview or the Navarre Florida area, there is a new program available for you. The U.S. Treasury has created the “Hardest-Hit Fund” to help the states struggling the most with foreclosures. Florida is one of those states-- ranking number one in mortgage delinquencies. According to the Mortgage Bankers Association more than 24 percent of Florida mortgages are at least one payment behind or in foreclosure. The new mortgage assistance program, run by the Florida Housing Finance Corporation will be expanded to cover the entire state on April 18, 2011.

How can the "Hardest-Hit Fund" help homeowners in Destin, Santa Rosa Beach, Crestview or Navarre Florida?

If you are unemployed or took a pay cut, you may be able to get six months of mortgage payments to keep your loan current, and avoid foreclosure. You might also be eligible to get past due payments (up to $6,000) covered if you have re-gained employment and can now continue to pay your mortgage.

One of the program’s main criteria is that the property is your primary residence and you don’t own other real estate. Your monthly mortgage debt must be more than 31% of your gross income. You must have a hardship, such as job loss, cut hours or reduced pay. You must not be more than 180 days behind in your mortgage payments. Your outstanding mortgage balance must be less than $400,000.

If you qualify, the Florida Hardest-Hit website says your assistance will be “a 0%-interest, deferred-payment loan that will be subordinate to current mortgages on the home. The loan is forgiven at a rate of 20% starting 18 months after acceptance into the program (over a five-year period). Additionally, a homeowner in the Unemployed Mortgage Assistance Program will be required to pay 25 percent of his/her monthly income toward the monthly mortgage payment, with a minimum payment of $70 per month.”
