How Not To Buy A Destin Florida Foreclosure




Do you think you're clever? Do you think you're gonna save a bundle and make a steal on a Destin Florida foreclosure? Are you skipping the real estate agent (ha ha - save on the commission) and saying "fuhget about" using an attorney? Please don't make the mistake one of my friends just did. He bought a Destin Florida foreclosure at the courthouse steps and it's all downhill from here.

Today I got a call from, I'll call him Kyle, to desperately and quickly sell a Destin property. The disaster story unfolded.... (Why didn't he call me before he did this? I don't know! But it's too late.)

There is a $10,000 association lien on the Destin house he just bought at auction. HE DIDN'T KNOW! Not only that, there are $300 per month association fees due - that he is now responsible for. HE DIDN'T KNOW!!! Now Kyle is in trouble. The association is demanding he pay up or they will take legal action to get their money. Of course, he did not budget for an extra $300 in monthly expenses to cover association fees. And past due monies are from the PREVIOUS DEFAULTING OWNER, not Kyle (but now it's his problem).

What did Kyle do wrong? How do I begin? When you buy a home at the courthouse steps, the court is not going to do a title search for you! Okaloosa County Florida says that is your problem. They even have a WARNING on their website:

BUYER BEWARE! All properties are sold "AS IS”. Bidders are responsible for conducting their own research as to the property being sold, its location or condition, the condition of any structures or fixtures thereon, its marketability, potential uses, zoning, or whether any other potential liens or other defects in title that may exist.

Guess what? Kyle messed up. Big time. He did not consult an attorney. He did not research the Destin subdivision. He did not conduct a title search to make sure there were no liens. Too late. He owns the property.

Now I have to sell it. Quick.

If you are buying a Destin Florida foreclosure - remember this: Do your homework. Hire an attorney. Hire a title agent. Consult with a Destin real estate agent who specializes in foreclosures.

Don't make the same mistake.

CitiMortgage Delays Destin Florida Foreclosures - Due to Oil Spill


Leading the mortgage industry, CitiMortgage has announced assistance for borrowers in financial trouble in the oil-threatened regions on the Gulf of Mexico. This is good news for Destin, Fort Walton Beach, Santa Rosa Beach and Navarre Florida short sale sellers. Citi is halting foreclosures on primary mortgages it owns through September 17. Eligible borrowers include those within 25 miles of the affected coastal regions.

Why is this good news? Destin short sale sellers will have more time to get their properties sold. Santa Rosa Beach short sale buyers will know that their contracts on Citi-mortgaged properties will be processed for approval without foreclosure threat. In addition, Citi is halting evictions on their foreclosed properties in the affected Emerald Coast areas.

The natural disaster looming in the Gulf of Mexico will put "unnatural" pressure on a real estate market still on the downslide. Even though there is a BP claims process in place (soon to be an independent party), there will be loss of income that is not accounted for and further job loss in the region. Of course, that will spike borrowers inability to make payments or find other employment.

CitiMortgage is really stepping up by taking this action. Destin, Fort Walton Beach, Santa Rosa Beach and Navarre Florida short sale sellers working to avoid foreclosure will have a greater chance of success. What else can be done? Other servicers and investors should follow suit.

Crystal Shores Home Approved as Destin Florida Short Sale


I received final approval from GMAC and Regions for this pending Destin Florida short sale in Crystal Shores. This unique Destin Florida home at 4495 Ocean View Drive, had a challenging short sale approval process.

The GMAC Broker Price Opinion came in much higher than the contract price. I submitted a counter-analysis of my own, which they accepted, proving the buyer's price was fair. Meanwhile, Regions did not know which department handled this particular short sale. Then GMAC would not complete their approval process, after three months of negotiating, until they had Regions letter in hand.

It sounds like a lot, but it was only a few months of wrangling. In the end, it worked.

If You Want To Sell Real Estate, Spend $180.00


My real estate market in Destin Florida, relies strongly on the use of the GE ActiveKey for access to listings. Only registered real estate agents can open lockboxes to get the key to the property. I check an online report daily to see who accessed my properties and when. I can email the showing agent for feedback with a personal touch. The system is widely used nationally, but there are alternate systems.

The problem in my Destin area occurs when we have the one or two odd agents who do not own a lockbox key. For some reason, they do not want to spend the $180 to buy a key to show 90% of the listings on the Emerald Coast. These agents expect the listing agent to jump out of their office and drive 20 miles at a moment's notice, to let them in a house. They seem bewildered that we cannot do this. I am bewildered that they cannot spend $180 as part of their business plan.

When you have a real estate license, and you have chosen real estate as your career, there are some minimal investments you should make. You should buy business cards, own a cell phone, computer, car, join your local association of Realtors, and be able to SHOW properties. In order to SHOW properties in Destin Florida, you need a lockbox key.

Not making this small investment brings up some questions. How are you serving your buyers when you cannot make timely appointments for them to see properties? If you have to make appointments with each listing agent, versus just popping over to the house with your key, don't you think you'll lose some sales? Won't your buyer lose out when someone sees the home first and beats them with an offer?

I realize that some rural areas use combo lockboxes. Other areas have automated feedback systems. But when you sell in Destin and the Emerald Coast, please get a lockbox key.

The $180.00 investment is a small price to pay. You might actually get a return on your investment.

What Would You Do If The Seller Defaults?



We often hear stories about buyers defaulting on contracts to purchase real estate. They "walk", they don't deposit their earnest money, they don't apply for their mortgage on time, they don't close by the closing date. But how often do you hear about SELLERS defaulting?

First, let's get the definition of default. According to the Florida Association of Realtors Residential Sale and Purchase Contract, Default is: "Seller fails, refuses or neglects to perform this contract".

I am not an attorney, but some examples of what seller default might be: failing to act on a required repair item, neglecting to remove tenants if specified in the contract, refusing to close.

Well, I had two cases in the last week. One example: I represent the buyer and the seller has decided not to do a required wood rot repair. The seller claims "he has done enough improvements" and is not doing any others. "The buyer should be happy."

According to the Florida contract, in the case of seller default, the buyer may "choose to receive a refund of buyer's deposit, without waiving the right to seek damages, or to seek specific performance". The contract goes on to outline the methods of dispute resolution.

The question is, with such a "minor" default, who would bother? If the wood rot is $100, should the buyer delay the closing to go through mediation, especially when he needs a home? If the seller did not leave the house broom-clean, if he failed to remove tenants on time, if he removed a small "attachment", should the buyer go to arbitration? If the closing were delayed a few days, and their is no per diem penalty paid, oh well?

In Florida, on both the buyer and seller side, these are not uncommon occurences. The problem is, if no one enforces the contract, nothing will change. You see, it is not normal custom in Northwest Florida to have individual attorney representation for our closings, like many other states. Thus, in the case of a default, the buyer or seller would have to spend extra monies to hire an attorney. They usually won't.

That is why Florida real estate transactions tend to have many of these nuisance defaults, and no one bothers. What say you?

Should I Still Buy a Home in Rosemary Beach Florida As Oil Impact Looms?




Yesterday I received this email from a potential Rosemary Beach, Florida real estate buyer.

Dear Wendy Rulnick:

We found you on the web. We were set on looking for a home between Rosemary Beach and Grayton Beach south of 30A. Our question is, how do you feel the long term impact of the oil spill will affect the area?

Thank you, "Unsure"


Dear "Unsure",

I sincerely think it is a big unknown. Obviously, there will be knee-jerk reactions at first should the oil hit our area on the Florida Panhandle. Buyers will be concerned because there is no definitive answer, and may put off real estate purchases. Thus, it might create more downward pressure on pricing. I think those who really love the 30-A, Rosemary Beach area in South Walton County, Florida, will still seek those communities. There are economic and area improvements coming due to the new Northwest Florida Beaches International Airport in Panama City. Another area-wide community-booster is Eglin Air Force Base's new F35 Joint Strike Fighter training program.

Meanwhile, BP tells us they will do whatever they need to keep our beaches beautiful. It is a top priority locally and at the state level. Governor Crist is fully involved. Walton County has both a protection and restoration plan.

No Price Too Big or Little If You Need To Sell Your Destin Florida Short Sale


Today I received a call from a potential Destin Florida short sale seller, timid to speak with me. Why? She had been told by the previous real estate agent she contacted, that listing her home was not worth her time! Why? It seems this property was worth under $100,000 and would be "a lot of work". The poor seller, who lost her job, told me she was hesitant to even contact another agent, thinking no one would help her. I told her, "Sure, a short sale is a lot of work, but this is what I do." I then explained the process of gathering documents, pricing, follow up and time involved in a short sale. I concluded with, "Of course, I can help you." She was almost stunned into silence.

Conversely, I've had sellers contact me with Destin luxury properties that were once valued at almost $2,000,000. They tried to hold on to their investment condos or homes and waited until they were well into the foreclosure process before they started a short sale. Why? Because they could not admit they needed help and thought something "might change". They drained almost everything from their savings and retirement plans to make payments. These sellers waited until it was almost too late for short sale assistance.

Homecomings Financial Won't Talk to Me- Unless I Give Wrong Zip Code for Navarre Florida!



I've sold real estate in Navarre Florida a long time. About 20 years to be exact. So I should know what the Navarre zip code is- 32566. Or so I thought.

I was calling Homecomings Financial on the status of one of my Navarre short sales. Of course, I going through the usual ninth-degree, name, rank and serial number before they would give me any information. Finally, the rep asks for the property address. I told her 9478 Parker Place, Navarre Florida 32566. She says, "That's not the zip code we have". First I wondered if I called the wrong bank, or had the wrong property. No, I quickly scanned my file and it was right.

I said, "Ma'am, Navarre has one zip code and it is 32566". Again, she repeated I was mistaken and she could not talk to me about the short sale. OK, am I going nuts? Maybe my listing wasn't in Navarre, or there was a new zip code I didn't know about. I said, "Hold on, I'll verify the zip code on the internet." Nope. One zip code for Navarre, Florida. Exasperated, I hung up and decided to do some digging.

I checked my physical file with payoff statement from Homecomings Financial. There it was. Their system had the Navarre Florida zip code wrong - 32568. Done with the phone nonsense, I had my assistant call back. She gave them the secret code- the wrong zip code, that is, and voila! They would talk to her. When she informed them they had the zip code wrong, they stated they would not change it unless my seller sent in a letter! For some reason they could not check U.S. Postal Service themselves.
