"You Will Be Personally Penalized” Said the Census Worker



Census Bureau workers are regularly calling and asking my office for confidential information about Destin Florida properties we have listed for sale. They are getting sneaky, too. I’ve instructed my office not to answer confidential questions on behalf of any of our sellers.

Yesterday one of my team was threatened by a Census Bureau worker that she would be "personally penalized" for not answering questions. They said, “Not your office- YOU will be penalized!” I am serious.

How sneaky are they becoming? The Census Bureau worker calls for me, will not say what the call is regarding and leaves a first name. Of course, my team is alerted that this is probably not a legitimate business call. We call back, and they start on the census questions, “Is the home occupied or vacant?” (Gosh, can’t they look in the window?) When we don't answer their questions, they start to get pretty ornery.

Why won't we answer confidential questions? How do I know if this caller really works for the Census Bureau? How do I know it is not a thief or scammer? How do I know if my seller would choose to answer these questions? Do I have permission to? I don’t, therefore I won’t.

Did You Sell Your Santa Rosa Beach Short Sale Too Fast?




This weekend I received an offer on a Santa Rosa Beach Florida short sale lot listing. In my area on the Emerald Coast, lots are not easy to sell. In fact, there is a 36 month absorption rate in South Walton County in the 30-A area. Yikes! A normal market may have a 6-7 month absorption rate. So it would take almost three years to sell the current inventory of Santa Rosa Beach lots at the current rate of sales.

For the sake of illustration, I listed the lot at $82,000. The last sale in the subdivision was in December, almost six months ago, for $85,000. There is another lot under contract listed at $79,000. There are three lots listed for sale in the $200’s (OVERPRICED) and two expired listings at $99,900 and in the $100’s.

AMAZINGLY, I received a full price offer within one day of listing this Santa Rosa Beach short sale. The seller accepted it. I also received a back-up offer for over list price.

What is happening here? Is there gold on the lot or an oil field? No!

Did I underprice the lot? No! The comparable sale and property under contract were right in line with my listing. In fact, the absorption rate of my market makes the lot price seemed overpriced.

Why did I sell this Santa Rosa Beach lot sell so quickly? Curious, I asked the buyer's agent. He said the buyer wanted THAT subdivision and had written an offer on the other lot under contract, but lost his bid. He was just waiting for another lot to come on the market. When it did, he jumped. I suspect the other offer was for the same reason.

So, what does it mean, when your property sells quickly, and for full price? It means two things. It was priced right, and you were lucky!

Deep Water Horizon Oil Rig Explosion – We Are On The Shore. Waiting.



If you don’t know – there was a major oil spill from the Deep Water Horizon drilling rig on April 20. It is in the Gulf of Mexico and all over the news. The oil is headed for Louisiana, Alabama, Mississippi, and maybe Northwest Florida. It might eventually hit the Florida Keys and perhaps move up the East Coast. Precautions are being taken, British Petroleum (BP), the government, fishermen and citizen volunteers are trying to stop all the leaks and remove the oil. That’s not why I am writing. You can read that information all over the news.

I live here in Destin Florida. Maybe some would say I should not post this on a public forum, as it might hurt real estate sales. Well, heck, I think Google caught wind of the oil spill already.

I am writing because we are worried. OK, we’re scared. The fisherman, the rental companies, the restaurants, the home cleaners, the retail shops. People are reading the news and cancelling their vacations. A lot of people. Can I blame them? I might do the same. OK, the oil is not here yet, but it could come here. There are a lot of unknowns.

So, what are we doing? We are waiting and working and volunteering and contributing, and hoping for the best. We are hoping the leaks will be capped, the detergent and burning and hay and hair will work. We are hoping as few creatures as possible will be affected by the spill. We are hoping life as we know it won’t change. But mostly we wait.

U.S. Military PCS Short Sale? Chase Tells Eglin Air Force Base Airman - They Don't Care


Are you a U.S. military service member at Eglin Air Force Base who has been relocated by the government to a new base? Do you have to do a short sale? Is your lender Chase? If so, you may not get any special consideration, despite PCS (permanent change of station) orders.

I am currently in negotiations with Wells Fargo and Chase, as junior lien holder, for a Fort Walton Beach Florida short sale. The Eglin Air Force Base seller was transferred, or PCSd (permanent change of station), to a new base and had to sell his home. Of course, he was substantially upside-down in his mortgage balance compared to his market value. He has no choice but to follow orders and relocate. He was not qualified for HAP due to the original purchase cut-off date of July 2006. There is little hope of renting out the property to cover the mortgage payments. This is a common scenario in my neck of the woods around Fort Walton Beach and Crestview Florida.

In the past few years, I have sold dozens of Eglin Air Force Base and Hurlburt Field military service member homes as short sales or VA Compromise sales. U.S. government orders were never questioned and always deemed a sufficient hardship. These are not voluntary relocations. They are required to ensure our safety and freedom. Not once have I had a request for cash or a promissory note from a short sale lender. That is, until now.

It seems that Chase, after sending its loan to a collection agency, feels that the open line of credit my military airman has on a charge card is sufficient for him to cash advance $25,000. With no release of the rest of his deficiency balance. There is no consideration to the new debt service our Eglin Air Force Base airman would incur. Chase’s stance is that he either pays $25,000 and remains liable for deficiency balance, or he pays $35,000 to settle the account in full.

That is, while he is fighting for us in Afghanistan.

Regions Approves Holley by the Sea, Navarre FL Short Sale


Regions Mortgage has approved a short sale in Holley by the Sea, Navarre, Florida. Regions has branches primarily in the South and Midwest. I have found they like to negotiate back and forth on short sales, more so than other lenders. They normally want a cash contribution, promissory note, or both, and prefer to move their liens onto other of the borrower's real estate assets. Regions has gotten some press lately as one of the few lenders who is yet to repay TARP funds to the U.S. Treasury, as well as federal charges against its subsidiary, Morgan Keegan & Company. Regions is fighting those charges.
